法務部為了嚴懲酒駕，特別修正刑法公共危險罪185-3條，未來酒測值只要超過0.25mg/l，不論有沒有肇事，原則上一律沒收車輛；另在同法中新增酒駕再犯致死罪，最重可處死刑。修正案送行政院審議。
目前只是法務部於2019年2月27日送行政院審查的刑法修正草案，都還沒送至立法院提案，更不可能是經過三讀通過的有效法律。
