前立委邱毅影射高雄市長陳菊在凡那比風災當天到田寮鄉某溫泉會館挨告。高雄地方法院今天宣判，合議庭認定邱毅已盡合理查證及無實質惡意，判邱毅無罪，全案可上訴。
合議庭表示，邱毅既經合理查證，並無實質惡意，尚難認有何散布謠言或傳播不實之事，而構成誹謗或違反選罷法之罪，因此，依罪證不足判邱毅無罪。
