海山警分局今天解釋，依據道路交通管理處罰條例第43條第1項第1款，照片中的行為，屬於「以其他危險方式駕車」，依「違反道路交通管理事件統一裁罰基準表」規定，開罰新台幣1萬2000元，且必須到新北市政府交通裁決處聽候裁決，也可以提出申訴。
