勞動局指出，依據職安法及高架作業勞工保護措施標準規定，高架作業勞工一旦被測出有酒精反應，酒醉或有酒醉之虞者，最重可罰雇主30萬元罰款。至於職業安全衛生設施規則並沒有第189條第88項的規定。
