一審確實由邱毅勝訴，但其勝訴原因為「邱毅既經合理查證，並無實質惡意，尚難認有何散布謠言或傳播不實之事，而構成誹謗或違反選罷法之罪，因此，依罪證不足判邱毅無罪。」並無法直接證明陳菊市長是否有泡湯等事。
