法律上只有「定金」，沒有「訂金」，雖然社會上常用「訂金」這個詞，但法律上依舊會當作「定金」來解釋，簡單來說，定金跟定金兩者都是一樣的，只是一個是法律上規定用詞，另一個是社會上的俗稱。
