依「選罷法」第56條規定，政黨及任何人不得於投票日從事競選、助選或罷免活動，違者最高可處500萬元。候選人以外的任何人，投票日當天雖可以從事公民投票宣傳，但不能穿插候選人姓名、政黨名稱、標語、旗幟、看板、號次等相關影像、聲音及文字。
