美國高院並沒有宣判舊金山合約至今仍然有效，而「台灣至今仍在美國軍事佔領中」也同樣是錯誤訊息。1971年中華民國政府即將失去聯合國代表席次那一年的4月28日，時任美國國務院發言人布瑞（Charles W. Bray）也在記者會宣稱：「台灣與澎湖主權是一尚待未來國際解決之懸而未決之問題」。
