依刑法第310條誹謗罪的刑度為一年以下有期徒刑，至於以散布文字圖畫方式所為的加重誹謗罪刑度則為二年以下有期徒刑。但在網路上罵人「渣男」的案件中，並不一定每則都會起訴判刑，也有不少是獲的不起訴處分結案（要看具體po文的內容而定，個案狀況不盡相同），縱起訴判刑法院也多半判處拘役而得以易科罰金。
